The Platform is operated by Malta Stock Exchange Institute Limited (“Investi”, “we”, “us”, or “our”).

Access to and use of the Platform is conditional upon your express acceptance of these Terms. If you do not agree, you must not access or use the Platform.

  • Funds;
  • Commodities;

No content on the Platform should be interpreted as a recommendation, endorsement, suitability assessment, or solicitation.

7. User Responsibility

By using the Platform, you agree that you are responsible for:

  • Educational material
  • Graphics
  • Logos
  • Branding
  • Videos
  • Images
  • Software
  • InvestiAI educational content

is owned by or licensed to Investi and protected by applicable intellectual property laws.

Users may access and use content for personal, non-commercial purposes only.

Content may not be copied, modified, distributed, reproduced, or used commercially without prior written permission from Investi.

11. Availability of Services

Investi may update, modify, suspend, or discontinue any part of the Platform, including features and services, at any time.

We do not guarantee that the Platform will always be available, uninterrupted, or free from errors.

Investi provides no assurances that any reported problems, errors or inaccuracies may be resolved by the use of any information or updates that Investi provides.

12. No Warranty

The Platform and its content are provided on an “as is” and “as available” basis.

Investi does not guarantee that:

  • The Platform will operate without interruption;
  • The Platform will be free from errors, viruses, or security issues.

To the extent permitted by law, Investi excludes all warranties relating to the Platform and its content. No information published on the Platform should be construed as a representation or warranty of any kind as to the state of any financial instrument, market or investment.

13. Limitation of Liability

To the fullest extent permitted by applicable law, none of Investi, Malta Stock Exchange p.l.c., their affiliates, officers, directors, employees, agents, licensors, or representatives (together, the “Investi Parties”) shall be liable to any user or third party for any loss, damage, cost, or expense of any kind, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, arising out of or in connection with:

  1. access to, use of, or inability to access or use the Platform;
  2. reliance on any educational content, materials, tools, or resources made available through the Platform;
  3. reliance on any output, explanation, summary, or content generated by InvestiAI;
  4. any error, inaccuracy, omission, or incompleteness in any information published on or accessible through the Platform;
  5. any technical failure, malfunction, outage, delay, interruption, or unavailability of the Platform or any part of it;
  6. any information, content, product, or service provided by or linked to a third party; or
  7. any unauthorised access to, alteration of, or loss of data submitted or stored via the Platform.

This exclusion applies to all losses and damages of any kind, whether direct, indirect, incidental, special, consequential, exemplary, or punitive, including without limitation loss of profits, loss of revenue, loss of anticipated savings, loss of business opportunity, loss of goodwill, loss of data, and any other financial or economic loss, in each case whether or not such losses were foreseeable and whether or not Investi has been advised of the possibility of such losses.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy.

By using the Platform, you acknowledge that your personal data will be processed in accordance with our Privacy Policy.

15. Changes to These Terms

Investi may update these Terms from time to time.

Updated versions will be published on the Platform and will become effective from the date of publication.

Continued use of the Platform after updated Terms are published constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of Malta.

Any disputes relating to these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of Malta.

If you choose to access the Platform from outside Malta, it is your responsibility to ensure compliance with all applicable local, national or international laws and regulations. Any use of the Platform outside Malta is entirely at your own risk.

17. Internet Communications and Confidentiality

In accessing the Platform, you acknowledge that electronic communications and other transmissions passing over the internet may not be free from interference by third parties and may not remain confidential. Although Investi has made reasonable efforts to maintain a secure system, Investi cannot guarantee the privacy or confidentiality of any information transmitted over the internet.

Unless otherwise expressly stated on the Platform, communications or transmissions sent to Investi through the Platform or by electronic mail shall not be considered as instructions, requests to purchase or obtain any product or service, investment orders, or formal complaints. Investi shall not be liable for any loss or damage arising in connection with any such communication or transmission.

18. Complaints

If you have a complaint regarding the Platform or any content provided through it, please contact Investi using the contact details set out in Section 22 below. Investi will endeavour to acknowledge and respond to complaints in a timely and fair manner.

19. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect.

20. Waiver

Investi’s failure to enforce any provision of these Terms, or any act or omission on the part of Investi, shall not constitute a waiver of Investi’s rights under these Terms and shall not prevent Investi from subsequently insisting on strict compliance with these Terms.

21. Entire Agreement

These Terms, together with the Privacy Policy and any other policies or notices published on the Platform, constitute the entire agreement between you and Investi in relation to your use of the Platform and supersede all prior representations, agreements, statements and understandings between you and Investi relating to the same subject matter.
