MFSA imposes €6,712.50 penalty over investment-services reporting failures

The regulator reached a settlement with an unnamed Investment Services Provider over late and missing reporting obligations relating to Notified AIFs.

The Malta Financial Services Authority (MFSA) published a communication on 18 August 2026 concerning an unnamed Investment Services Provider following an investigation into late and missing regulatory submissions.

Reporting shortcomings identified

The breaches relate to SLC 5.02 and SLC 5.02(i)-(iii) of Part B of the Investment Services Rules for Notified AIFs.

The MFSA identified several reporting failures, including the late submission of audited financial statements for the year ended 31 December 2022 and the failure to submit the 2023 Annual Report.

Other shortcomings involved Annual Fund Returns, Representation Sheets and Auditor’s Reports for the relevant 2022 and 2023 reporting periods.

€6,712.50 settlement agreed

On 11 August 2026, the MFSA reached a settlement with the provider and imposed an administrative penalty of €6,712.50.

The Authority said it took into account the goodwill shown by the provider when agreeing to settle the outstanding matters. The communication was published in line with the MFSA’s Settlement Policy.

The case is particularly relevant to fund managers and investment-services providers, as it highlights the importance of meeting regulatory reporting requirements applicable to Notified Alternative Investment Funds.
